In this case, OYM AG reserves the right to charge the customer reminder fees in addition to the invoice amount. OYM accepts no liability for damage or physical injury resulting from the misuse of the items, equipment, and facilities provided.<\/li><li>Damage caused by the guest intentionally or through negligence may be billed by OYM.<\/li><li>Smoking is not permitted on any OYM premises. Resignation of the OYM<\/h3>\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-42e9ba8 elementor-widget elementor-widget-text-editor\" data-id=\"42e9ba8\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t\t\t\t\t\t<ol><li>OYM is entitled to terminate the contract with immediate effect if entering into, continuing, or fully performing the contractual relationship is not, or is no longer, reasonable. This applies in particular if: <\/li><li><\/li><li>force majeure or other circumstances beyond OYM\u2019s control render the performance of the contract unreasonable;<\/li> <li>event spaces were booked based on misleading or false statements regarding material facts (e.g., regarding the identity of the service recipient or the purpose of the event);<\/li> OYM has reasonable grounds to believe that the use of the service may jeopardize the smooth operation of the business, the safety, or the reputation of other guests and\/or OYM, without this being attributable to OYM\u2019s sphere of control or organizational responsibility.<li>In the aforementioned cases, the OYM is entitled to immediately terminate the contract, and the service recipient shall have no claim for damages. Any advance payments or payment guarantees made by the guest shall be forfeited or shall be due to the OYM in accordance with the provisions set forth in Section 8.<br \/><\/li><\/ol>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t<div class=\"elementor-element elementor-element-6252684 e-con-full e-flex e-con e-child\" data-id=\"6252684\" data-element_type=\"container\" data-e-type=\"container\">\n\t\t\t\t<div class=\"elementor-element elementor-element-f54933c elementor-widget elementor-widget-heading\" data-id=\"f54933c\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"heading.default\">\n\t\t\t\t\t<h3 class=\"elementor-heading-title elementor-size-default\">8. Liability of the OYM<\/h3>\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-932a200 elementor-widget elementor-widget-text-editor\" data-id=\"932a200\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t\t\t\t\t\t<ol><li>In general, OYM is liable to the guest only for damages caused to the guest intentionally or through gross negligence, which occurred as a direct result of a failure to perform or a material breach of the contractual obligations assumed by OYM. In any case, the amount of damages shall be limited to a maximum of the accommodation fee (excluding VAT) booked by the guest or actually paid upon termination of the stay.<\/li><li>Should disruptions or defects in OYM\u2019s services occur, OYM will endeavor to remedy the situation upon becoming aware of them or upon receiving an immediate complaint from the guest. The guest is obligated to do everything reasonably possible to resolve the disruption and minimize any potential damage, as well as to notify OYM immediately of any disruptions or damage.<\/li><li>OYM is also liable for loss or damage to personal belongings only in cases of willful misconduct or gross negligence. To the extent that the hotel is legally liable for third parties, it is liable only if there is gross negligence on the part of the third party; OYM\u2019s liability is excluded if the third party caused the damage intentionally.<\/li><li>OYM\u2019s liability is expressly limited, in particular with regard to third-party and consequential damages, to the amount covered by OYM\u2019s liability insurance. Any liability beyond this is expressly excluded. OYM is not liable for damages resulting from force majeure.<\/li><li>Any liability claims shall be forfeited without compensation if the guest does not notify the OYM in writing immediately upon becoming aware of any loss, destruction, or damage.<\/li><li>The OYM shall not be liable for the loss or damage of the guest\u2019s parked or maneuvered motor vehicles and their contents on the OYM premises, unless such loss or damage is due to willful misconduct or gross negligence.<\/li><li>Messages, mail, and packages for guests will be handled with care. OYM will deliver or store them upon request. The OYM reserves the right to grant the organizer\u2014in exchange for a fee\u2014a time-limited, non-exclusive license to use the trademarks and\/or logos to which it is entitled.
